The International Longshore and Warehouse Union Local 142 (“ILWU Local 142”) values its users’ privacy and protecting your private information is our priority. This Privacy Policy (“Policy”) will help you understand how we collect and use personal information from those who visit our website or make use of our online facilities, services and application, and what we will and will not do with the information we collect.  This Policy applies to the ILWU Local 142 website (https://www.ilwulocal142.org)("Website”), and Hustle (ILWU Local 142’s application) (“Application”), and governs data collection and usage by us. For the purposes of this Policy, unless otherwise noted, all references to ILWU Local 142 include https://www.ilwulocal142.org, ILWU Local 142 and Hawaii Longshore Division. The ILWU Local 142 Application is a news and information application. By using the ILWU Local 142 Website and Application, you consent to the data collection practices described in this Policy.

It is always up to you whether to disclose personally identifiable information to us, although if you elect not to do so, we reserve the right not to register you as a user or provide you with any services.

In order to better provide you with services offered, ILWU Local 142 may collect personally identifiable information, such as your:

ILWU Local 142 may also collect non-personal anonymous demographic information, which is not unique to you, which will assist us in providing and maintaining superior quality service, such as your:

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain services. These may include: (a) registering for an account;  or (b) sending us an email message. To wit, we will use your information for, but not limited to, communicating with you in relation to services you have requested from us. We also may gather additional personal or non-personal information in the future.

We are collecting your data for several reasons:

  • To better understand your needs and provide you with the services you have requested;
  • To fulfill our legitimate interest in improving our services;
  • To fulfill our fiduciary duties to our members as laid out in the ILWU Constitution, By-Laws and policies;
  • To send you emails containing information we think you may like when we have your consent to do so;
  • To customize our website according to your online behavior and personal preferences;
  • To inform you of other services available from ILWU Local 142 and its affiliates. 

The data we collect from you will be stored for no longer than necessary.  The length of time we retain said information will be determined based upon the following criteria: the length of time your personal information remains relevant; the length of time it is reasonable to keep records to demonstrate that we have fulfilled our duties and obligations; any limitation periods within which claims might be made; any retention periods prescribed by law or recommended by regulators, processional bodies or associations; the type of contract we have wit you, the existence of your consent, and our legitimate interest in keeping such information as stated in this Policy.

Sharing Information with Third Parties 

ILWU Local 142 does not sell, rent, or lease its member lists to third parties. 

ILWU Local 142 may share data with trusted partners to help perform statistical analysis, or send you email or postal mail. All such third parties are prohibited from using your personal information except to provide these services to ILWU Local 142, and they are required to maintain the confidentiality of your information. 

"Text messaging opt-in is excluded from information sharing with third parties."  

ILWU Local 142 may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on ILWU Local 142 or the site; (b) protect and defend the rights or property of ILWU Local 142; and/or (c) act under exigent circumstances to protect the personal safety of users of ILWU Local 142, or the public.

As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through this Site cannot be guaranteed. 

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will: 

•     Delete your personal information from our records; and 

•     Direct any service providers to delete your personal information from their records. 

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to: 

•     Complete the transaction for which the personal information was collected, fulfill the terms of a written contract provide a service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us; 

•     Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; 

•     Debug to identify and repair errors that impair existing intended functionality; 

•     Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law; 

•     Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent; 

•     Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; 

•     Comply with an existing legal obligation; or 

•     Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information. 

Children Under Thirteen 

ILWU Local 142’s Website and Application is not directed to and does not knowingly collect personally identifiable information from children under the age of thirteen (13).  If it is determined that such information has been inadvertently collected on anyone under the age of thirteen (13), we shall immediately take the necessary steps to ensure that such information is deleted from our system’s database, or in the alternative, that verifiable parental consent is obtained for the use and storage of such information.  Anyone under the age of thirteen (13) must seek and obtain parent or guardian for permission to use this Website or Application.

Unsubscribe or Opt-Out 

From time to time, ILWU Local 142 may contact you via text or email for the purpose of providing announcements, alerts, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from ILWU Local 142 or click on a link therein. 

If you would like to stop receiving communications via text or email from ILWU Local 142, you may opt out of such communications by unsubscribe@ilwulocal142.org.

We may store your data on servers provided by third party hosting vendors with whom we have contracted.

ILWU Local 142 reserves the right to change this Policy at any given time.  If you want to make sure that you are up to date with the latest changes, we advise you to frequently visit this page. If at any point in time the ILWU Local 142 decides to make sure of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, user or users shall be promptly notified by email, by placing a prominent notice on our Website or Application, and/or by updating any privacy information.
