Pre-Election Hearing
A date is set for pre-election hearing:
The Union and the Company will either:
1. “Stipulate to the election,” which means that an agreement is reached on:
- who will be in the bargaining unit; and
- set the date(s), time(s) and place(s) of the election.
2. “Fail to consent to the election,” which means that formal NLRB hearings are needed:
- in order to rule on the election and;
- set the date(s), time(s) and place(s) of the election.
The company is required to provide the Union with a list of the employees who are eligible to vote. The list must contain the names and addresses of eligible employees.
A union observer will also be chosen to observe the election process.
